EV SESSION TERMS

 

By signing up for a session, you agree to the following Terms AND Conditions between you (“you”) and ecstatic Voice LLC (“US” and “WE”):

Each EV Session (the "session") includes:

  • An assessment questionnaire to complete at booking

  • A 90-minute one-on-one working session on Zoom

  • A review of relevant materials by Cate ahead of time

  • A Notion page with session recording and transcript

INVESTMENT

The fee is $475 and payable in full when you book your session. Sessions are nonrefundable.

RESCHEDULING

If you need to change your session time, you may do so up to 24 hours ahead of your original time by clicking the reschedule link in your confirmation email. If you don’t see a time that works, email Cate at cate at ecstaticvoice.co and we’ll find one that does. Late cancellations and no-shows may not be rescheduled.

COMMITMENT

The session requires your commitment of time, collaboration, and participation. You commit to giving your full attention during the session, providing truthful and accurate information, staying open to receiving feedback and experimenting with new strategies, communicating questions or needs to us, and participating wholeheartedly.

CONFIDENTIALITY

We will hold the personal information you provide to us during your session as sensitive and confidential in nature, and will not share it with any party without express written consent from you via email, except in the case of an emergency or if we are required to by law.

ECSTATIC VOICE CONTENT

We own all of the content, materials, exercises, and tools that we provide to you (“Ecstatic Voice Content”) during or outside of our session. You agree not to share, copy, modify, sell or otherwise distribute Ecstatic Voice Content to anyone else, or use it for any purpose other than your personal use.

COLLABORATIVE CONTENT

If we co-create any content or edit any of your content, such as your resume, portfolio, website, social media accounts, messaging content, and other positioning content, we grant you a perpetual license to use that content as you see fit. If you decide to make any further changes to that content once the Program has ended, you agree to not attribute those changes or that content to us..

PERSONAL RESPONSIBILITY & ARTISTIC RELEASE

You understand that you are 100% responsible for your own progress and results. We cannot guarantee any particular results or outcomes for you in connection with the session, financially or otherwise. All services are provided as is. The services do not include any sales support or strategic introductions. While we will strive to give you the best guidance and tools possible, we are not business advisors, life coaches, or career counselors. Our services are creative and subjective, and you understand that your dissatisfaction with our independent judgment or working style are not valid reasons to withhold payment or request a refund.

DISCLAIMERS

You agree to indemnify, defend, and hold us and our principals, employees, and contractors harmless against any and all claims, including reasonable attorneys' fees and costs, arising out of or related to our services. OUR LIABILITY TO YOU IS LIMITED TO THE AMOUNT OF THE FEE PAID TO US, AND WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR DAMAGES SUCH AS LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES. (Our lawyer told us that part needed to be in all caps. Sorry for yelling.)

MISCELLANEOUS legal stuff

This Agreement shall be construed according to the laws of the State of California. No association, partnership, joint venture, employee or agency relationship is being created between you or us for any reason, and neither party may assign this Agreement to any other party. Any notifications may be sent to the us via email at cate at ecstaticvoice.co with notice due upon receipt, and notice may be sent to you at the email address you provided when you paid for the session. No invalidity, illegality or unenforceability of any provision herein shall affect any other term or provision of this Agreement. In the event that any provision of this Agreement is deemed illegal or unenforceable, the remaining portions of the Agreement shall remain in full force.
